Terms of Service

Article 1 - Definitions

In these terms, the following definitions apply:

  • Cooling-off Period: The time frame within which a consumer can exercise their right of withdrawal.
  • Consumer: Any individual acting outside of their business, trade, or profession who enters into a remote contract with Immanuel Montreal.
  • Day: Refers to a calendar day.
  • Continuing Performance Contract: A contract involving regular delivery of goods, services, or digital content over a specified period.
  • Durable Medium: Any means that allow consumers or Immanuel Montreal to store information in a way that permits future access and unchanged reproduction.
  • Right of Withdrawal: The consumer's right to cancel a remote contract within the cooling-off period.
  • Entrepreneur: Immanuel Montreal, the company offering products and services to consumers remotely.
  • Distance Contract: A contract between Immanuel Montreal and the consumer, where the sale of products or services is conducted entirely through remote communication channels.
  • Means of Distance Communication: Tools used to form a contract without the consumer and Immanuel Montreal being physically present in the same location.
  • General Terms and Conditions: These terms of service for Immanuel Montreal.

Article 3 - Applicability

These terms apply to every offer made by Immanuel Montreal and every contract concluded remotely between Immanuel Montreal and the consumer. The terms will be provided to the consumer prior to the conclusion of the contract. If necessary, they will also be made available electronically and can be sent upon request at no charge.

In the case that specific product or service terms apply, these will take precedence if they benefit the consumer more than the general terms.

If any provision in these terms is found to be invalid, the rest of the agreement remains enforceable, and the invalid provision will be replaced by a new one that closely aligns with the original intent.

Article 4 – The Offer

If an offer is time-sensitive or comes with specific conditions, this will be clearly indicated. Immanuel Montreal reserves the right to change or modify offers.

Offers will provide a clear and accurate description of the goods or services, including price (excluding any customs or VAT charges), shipping costs, and payment methods. Immanuel Montreal will ensure that product images are as accurate as possible, though they cannot guarantee the colors in the images exactly match the actual product.

The offer will include:

  • The total price, excluding customs duties and import VAT. These additional costs will be the consumer’s responsibility.
  • Shipping costs, if applicable.
  • How to complete the purchase and any required actions.
  • Payment, delivery, and order fulfillment details.
  • Duration of the offer.
  • Information on the right of withdrawal, where applicable.
  • Any relevant conditions regarding communication, contract archiving, and languages available for the contract.

Article 5 – The Agreement

The contract is finalized when the consumer accepts the offer and complies with its conditions. If the consumer agrees electronically, Immanuel Montreal will promptly confirm receipt of the acceptance.

If the consumer opts for electronic payment, Immanuel Montreal will take appropriate security measures.

Immanuel Montreal reserves the right to assess whether the consumer can meet their payment obligations and may refuse an order if necessary. The consumer will be notified if their order is declined or if additional conditions are required.

Article 6 – Right of Withdrawal

Consumers may cancel a purchase within 14 days of receiving the product without providing a reason. During this period, the consumer should handle the product carefully and only use it as necessary to assess whether they wish to keep it.

If the consumer wishes to withdraw, they must notify Immanuel Montreal within the cooling-off period and return the product within 14 days of notifying the company.

Article 7 – Costs of Withdrawal

If the consumer exercises the right of withdrawal, they will be responsible for the cost of returning the product. Immanuel Montreal will refund any payment received within 14 days of receiving the product or proof of return.

Article 8 – Exclusions from Right of Withdrawal

Immanuel Montreal may exclude certain products from the right of withdrawal, including but not limited to:

  • Custom-made or personalized products.
  • Perishable goods.
  • Sealed products such as software or hygiene products, if the seal has been broken.

The exclusion will be clearly stated in the offer.

Article 9 – Prices

Prices will not increase during the offer's validity period, except in the case of VAT changes. Prices may fluctuate based on market conditions beyond Immanuel Montreal’s control, such as currency exchange rates.

For orders outside the EU, import VAT and clearance costs will be collected by the delivery service. Immanuel Montreal will not charge VAT.

Article 10 – Conformity and Warranty

Immanuel Montreal guarantees that its products and services meet the specifications outlined in the offer. Any defects or issues must be reported within 14 days of delivery. Returns must be made in original packaging.

The warranty does not apply in cases where the product has been misused, altered, or exposed to abnormal conditions.

Article 11 – Delivery and Execution

Immanuel Montreal will handle and fulfill orders with the utmost care. If a delay or partial fulfillment occurs, consumers will be notified within 30 days. Consumers are entitled to cancel the contract and receive a refund if delivery is not possible within the agreed timeframe.

Article 12 – Duration and Termination of Contracts

Consumers can terminate an ongoing contract for regular product delivery at any time, subject to a one-month notice period. For fixed-term contracts, consumers can terminate at the end of the agreed period.

Article 13 – Payment

Payments must be made within 7 working days unless otherwise agreed. Consumers must notify Immanuel Montreal of any discrepancies in payment details.

Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of discovering any defects. Immanuel Montreal will respond to complaints within 14 days and endeavor to resolve any issues promptly.

Article 15 – Disputes

All agreements and terms are governed by Canadian law, even if the consumer resides abroad.
